1. Who we are

These terms are an agreement between you and Echo 10x (trading as Echo 10X), based in Australia("Echo 10X", "we", "us"). Echo 10X runs a community Rust game server, this website and an online store selling digital in-game perks such as kits, ranks, bundles and queue skips.

2. Acceptance

By using this website, the Echo 10X server or the store, you agree to these terms, our Privacy Policy, Refund Policy, Acceptable Use Policy and the server rules. If you do not agree, do not use the service. You must be old enough to enter a binding contract where you live, or have a parent or guardian's permission.

3. Your account

You sign in with Discord or Steam. Keep those accounts secure — you are responsible for all activity under your Echo account. Provide accurate information, including the Steam account purchases should be delivered to.

4. Purchases, payments and billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, cancellations and refunds are handled under Paddle's Buyer Terms. Prices are shown in AUD. Kits and ranks give access for the period stated on the product (for example 30 days). Digital items are a limited, personal, non-transferable licence to use perks on the Echo 10X server; they have no cash value and cannot be resold or traded.

5. Acceptable use

You must not misuse the service, including by:

• using it for anything unlawful, fraudulent or for spam;
• infringing anyone's intellectual property;
• introducing malware, probing or attacking our systems, or scraping the site;
• cheating, exploiting or breaking the server rules.

6. Intellectual property

We own the Echo 10X name, logo, website, software, artwork and documentation. You may not copy, reverse engineer, redistribute or resell them. Rust is a trademark of Facepunch Studios; Echo 10X is independent and not affiliated with or endorsed by Facepunch Studios.

7. Service level

We work hard to keep things running, but we do not guarantee the server, website or store will be uninterrupted or error-free. The server wipes on a schedule, and maintenance, game updates or outages may happen. Gameplay, features and perks may change over time.

8. Suspension and termination

We may suspend or end your access to the server, store or account for a material breach of these terms or the rules, non-payment or chargebacks, security or fraud risk, or repeated or serious policy violations. Your rights under the Australian Consumer Law are not affected.

9. Warranties and liability

To the extent permitted by law, the service is provided "as is", and we are not liable for indirect or consequential loss. Our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms excludes rights or guarantees you have under the Australian Consumer Law or other laws that cannot be excluded.

10. Changes and governing law

We may update these terms; continued use means you accept the updated version. These terms are governed by the laws of New South Wales, Australia.
